Employers often anchor salary negotiations on prior salary, although it doesn't objectively measure a worker's value, and its use perpetuates inequities based on race and gender. To combat this structural bias, many states have enacted measures like salary history bans; as of December 2020, 19 states had some version of a salary ban. Colorado prohibits employers from asking about prior salary, using it in hiring and compensation decisions, or retaliating against applicants who don't disclose it.
